We are pleased that you have chosen Helios. While we have the utmost confidence in all of our UberLux products, if a technical problem should arise, please observe the information below.

The warranty period for Helios light panel is 12 months from the invoiced date of purchase. It is essential to keep the purchase receipt and original packaging. If a problem arises, the first line of action is to contact the merchant (or individual) from whom you purchased your Helios or contact our support team at 317.593.5939 or support@helios-light.com. Services under the terms of guarantee can only be completed with a valid purchase receipt. WARRANTY LIMITATIONS SUBJECT TO CONSUMER LAW

TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. UBERLUX DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. INSOFAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, UBERLUX LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT UBERLUX’S OPTION, THE REPAIR OR REPLACEMENT SERVICES DESCRIBED BELOW. SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY (OR CONDITION) MAY LAST, SO THE LIMITATION DESCRIBED ABOVE MAY NOT APPLY TO YOU.

WHAT IS COVERED BY THIS WARRANTY? UberLux Inc. (“UberLux”) warrants the UberLux-branded hardware product and the UberLux-branded accessories contained in the original packaging (“UberLux Product”) against defects in materials and workmanship when used normally in accordance with UberLux’s published guidelines for a period of ONE (1) YEAR (“Warranty Period”) from the date of original purchase by the end-user purchaser. UberLux’s published guidelines include but are not limited to information contained in technical specifications, quick start guides, and service communications.

WHAT IS NOT COVERED BY THIS WARRANTY? UberLux does not warrant that the operation of the UberLux Product will be uninterrupted or error-free. UberLux is not responsible for damage arising from failure to follow instructions relating to the UberLux Product’s use. This Warranty does not apply: (a) to consumable parts, such as power sources, or LED diodes that are designed to diminish over time, unless failure has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches, dents discoloration and chipped powder coating unless failure has occurred due to a defect in materials or workmanship; (c) to damage caused by accident, abuse, misuse, fire, liquid contact, earthquake or other external cause; (d) to damage caused by operating the UberLux Product outside UberLux’s published guidelines; (e) to damage caused by service (including upgrades) performed by anyone who is not a representative of UberLux; (f) to an UberLux Product that has been modified to alter functionality or capability without the written permission of UberLux; (g) to defects caused by normal wear and tear or otherwise due to the normal aging of the UberLux Product, inclusive of damage caused by acetone-based solvents; or (h) if UberLux receives information from relevant public authorities that the product has been stolen or you cannot prove in any way that you are the authorized user of the product (e.g., by presenting proof of purchase).

YOUR RESPONSIBILITIES Before receiving warranty service, UberLux or its agents may require that you furnish proof of purchase details, respond to questions designed to assist with diagnosing potential issues and follow UberLux’s procedures for obtaining warranty service. Following warranty service your UberLux Product or a replacement device will be returned to you as your UberLux Product was configured when originally purchased, subject to applicable updates. NOTICE: Do not open the UberLux Product. Opening the UberLux Product invalidates the Warranty and may cause personal injury. Only UberLux certified personnel are authorized to perform service on this UberLux Product.

WHAT WILL UBERLUX DO IN THE EVENT OF A WARRANTY CLAIM? If, during the Warranty Period, you submit a claim to UberLux in accordance with this warranty, UberLux will, at its option: (i) repair the UberLux Product using new or previously used parts that are equivalent to new in performance and reliability, (ii) replace the UberLux Product with the same model (or with your consent a product that has similar functionality) formed from new and/or previously used parts that are equivalent to new in performance and reliability When an UberLux Product or part is replaced, any replacement item becomes your property and the replaced item becomes UberLux’s property.

HOW TO OBTAIN WARRANTY SERVICE Please access and review the online help resources before seeking warranty service. If the UberLux Product is still not functioning properly after making use of these resources, please contact an UberLux representative at support@helios-light.com. An UberLux representative will help determine whether your UberLux Product requires service and, if it does, will inform you how UberLux will provide it.

WARRANTY SERVICE OPTIONS UberLux will provide mail-in warranty service if UberLux determines that your UberLux Product is eligible for warranty. Once eligibility has been established at the time of the claim, UberLux will send you prepaid postage and instructions on how to package your unit for warranty service at a UberLux Repair Service (URS) location. Instructions may be sent via email or hard copy. When service has been completed, the URS provider will return the UberLux Product to you. UberLux will pay for shipping to and from your location if all instructions regarding the method of packaging and shipping the UberLux Product are followed. UberLux reserves the right to change the method by which UberLux may provide warranty service to you, and your UberLux Product’s eligibility to receive a particular method of service. You may be responsible for shipping and handling charges if the UberLux Product cannot be serviced in the country it is in. If you seek service in a country that is not the original country of purchase, you must comply with all applicable import and export laws and regulations and be responsible for all custom duties, V.A.T. and other associated taxes and charges. Where international service is available, UberLux may repair or replace UberLux Products and parts with comparable UberLux Product and parts that comply with local standards.

LIMITATION OF LIABILITY EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, UBERLUX IS NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY. THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS, OR ANY STATUTORY LIABILITY FOR INTENTIONAL AND GROSS NEGLIGENT ACTS AND/OR OMISSIONS. UBERLUX DISCLAIMS ANY REPRESENTATION THAT IT WILL BE ABLE TO REPAIR ANY UBERLUX PRODUCT UNDER THIS WARRANTY.
